Terms and Conditions
- SCOPE
- Jio Everywhere Connect™ (“Jio Connect”) is a service provided by Reliance Jio Infocomm Limited, having Registered Office at Office -101, Saffron, Nr. Centre Point, Panchwati 5 Rasta, Ambawadi, Ahmedabad-380006, Gujarat, India, and/or its affiliates (“Company”, “we” or “us”) which enables inter-se communication between Smart Wearable Device (hereinafter defined) and Mobile Phone (hereinafter defined).
- Your (“you”, “your” or “user”) use of Jio Connect is subject to: (i) the terms and conditions as herein contained; and (ii) the terms and conditions of the Customer Application Form (“CAF”) submitted by the user for the purposes of availing the telecommunication services of the Company; and (iii) the privacy policy of the Company available at [*] (hereinafter collectively referred to as “Terms and Conditions”). In the event of any conflict between any terms and conditions recorded herein below and the CAF, the latter shall take precedence and prevail over the former.
- Jio Connect allows you to use your Smart Wearable Device to make and receive calls and use data on the Company’s network even when you’re not connected via bluetooth to your compatible Mobile Phone paired with Smart Wearable Device. - Your use of Jio Connect requires that, you agree to the Terms and Conditions. Please read them carefully. If you do not understand the Terms and Conditions, or do not accept any part of them, then you should not use Jio Connect.
- “Smart Wearable Device”, for the purpose of these T&C, shall mean and include, the wearable device which is capable of availing Jio Connect services.
- “Mobile Phone”, for the purpose of these T&C, shall mean and include, the device which (a) is capable for availing Jio Connect Services, and (b) have latest software update or latest application update for functioning with Smart Wearable Device.
- PRIVACY AND PROTECTION OF PERSONAL INFORMATION
- The privacy policy of the Company available here shall be read together with the CAF and shall form an integral part of the Terms and Conditions.
- Please note that your use of Jio Connect on your Smart Wearable Device and Mobile Phone may also be subject to the respective privacy policies as may be published / made available by the Smart Wearable Device and Mobile Phone.
- MODIFICATIONS
- Modifications of Terms and Conditions: The Company reserves the right to change the Terms and Conditions under which Jio Connect, including but not limited to the charges, if any, associated with the use of Jio Connect. These Terms and Conditions may be further modified by the Company based on changes in the business, legal and regulatory requirements and will be updated online. The Company will make all efforts to communicate any significant changes to this Terms and Conditions to you. You are encouraged to periodically visit this page to review the T&C and any changes to it.
- Modification of Services: The Company reserves the right to add, modify or delete any content or features available in the services at any time at its sole discretion.
- PERSONAL AND NON-COMMERCIAL USE LIMITATION
- Services offered by Jio Connect are intended for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from Jio Connect.
- UNLAWFUL OR PROHIBITED USE
- As a condition of your use of Jio Connect, you warrant to the Company that you will not use Jio Connect for any purpose that is unlawful or prohibited by these Terms and Conditions. You may not use Jio Connect in any manner which could damage, disable, overburden or impair the services or interfere with any other party's use and enjoyment of Jio Connect.
- The users are not entitled to use any kind of measures, mechanisms or tools (software or hardware) that could interfere with the functioning of the Jio Connect or any of its services.
- LIABILITY DISCLAIMER
- TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CONTRACT AND IN THE LAW OF TORTS, THE JIO CONNECT SERVICES IS PROVIDED ‘AS IS’ BASIS AND COMPANY MAKES NO WARRANTIES, CONDITIONS, REPRESENTATIONS OR GUARANTIES OF ANY KIND, EITHER EXPRESSED, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, TITLE, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE IN RELATION TO THE JIO CONNECT SERVICE. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THE TERMS AND CONDITIONS.
- ANY CLAIMS, ISSUES, DAMAGES OR LOSSES WITH RESPECT TO THE MOBILE PHONE AND SMART WEARABLE DEVICE SHALL BE THE SOLE RESPONSIBILITY AND LIABILITY OF THE MANUFACTURER OF THE MOBILE PHONE AND SMART WEARABLE DEVICE RESPECTIVELY AND THE COMPANY (INCLUDING ITS AFFILIATES, GROUP COMPANIES OR PARENT COMPANY, AND THEIR RESPECTIVE DIRECTORS, SHAREHOLDERS, OFFICERS AND EMPLOYEES) HEREBY DISCLAIMS, ANY AND ALL CLAIMS, LOSSES AND LIABILITIES, WHETHER OR NOT ARISING OUT OF, OR IN CONNECTION WITH (A) THE TERMS AND CONDITIONS; AND/OR (B) USE OF JIO CONNECT; AND/OR (C) USE OF THE SMART WEARABLE DEVICE; AND/OR (D) USE OF MOBILE PHONE; AND/OR (E) ANY COMBINATION OF THE FOREGOING. THIS DISCLAIMER SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND SHALL SURVIVE CANCELLATION/TERMINATION/DETERMINATION OF THE TERMS AND CONDITIONS.
- TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY HEREBY DISCLAIMS ALL LIABILITY RELATED TO ANY PROPERTY DAMAGE, PERSONAL INJURY, ILLNESS, DISEASE OR DEATH THAT MAY OCCUR DURING YOUR USE OF JIO CONNECT ON THE SMART WEARABLE DEVICE AND /OR MOBILE PHONE, INCLUDING ANY CLAIMS BASED ON THE VIOLATION OF ANY APPLICABLE LAW, RULE, OR REGULATION OR YOUR ALLEGED NEGLIGENCE OR OTHER TORT LIABILITY.
- YOU SPECIFICALLY AGREE THAT THE COMPANY SHALL NOT BE RESPONSIBLE FOR UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, ANY MATERIAL OR DATA OR CALLS SENT OR RECEIVED OR NOT SENT OR RECEIVED, OR ANY TRANSACTIONS ENTERED INTO THROUGH JIO CONNECT. YOU SPECIFICALLY AGREE THAT THE COMPANY IS NOT RESPONSIBLE OR LIABLE FOR ANY THREATENING, DEFAMATORY, OBSCENE, OFFENSIVE OR ILLEGAL SERVICES OR CONDUCT OF ANY OTHER PARTY OR ANY INFRINGEMENT OF ANOTHER'S RIGHTS, INCLUDING INTELLECTUAL PROPERTY RIGHTS. YOU SPECIFICALLY AGREE THAT THE COMPANY IS NOT RESPONSIBLE FOR ANY SERVICES SENT USING JIO CONNECT.
- TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY HEREBY DISCLAIMS ALL LIABILITY RELATED TO AND/OR ARISING OUT OF (A) NON-CONNECTIVITY OF SERVICE WITH THE MOBILE DEVICE, AND/OR (B) NON-CONNECTIVITY OF SERVICE WITH THE SMART WEARABLE DEVICE, AND/OR (C) NON-PAIRING BETWEEN SMART WEARABLE AND MOBILE PHONE, AND/OR (D) NON-TRANSMISSION OF DATA BETWEEN SMART WEARABLE DEVICE AND MOBILE PHONE, AND/OR (E) ANY COMBINATION OF THE FOREGOING. DISCLAIMER SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND SHALL SURVIVE CANCELLATION/TERMINATION/DETERMINATION OF THE TERMS AND CONDITIONS.
- IN NO EVENT SHALL THE COMPANY AND/OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR OR IN RELATION TO: (A) LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF JIO CONNECT, WITH THE DELAY OR INABILITY TO USE JIO CONNECT OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE AND SERVICES OBTAINED THROUGH JIO CONNECT, OR OTHERWISE ARISING OUT OF THE USE OF, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF THE COMPANY OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES; (B) OUT OF OR RELATING TO THE FUNCTIONALITY OF MOBILE PHONE AND THE SMART WEARABLE DEVICE.
- TERMINATION/ACCESS RESTRICTION
- In case a user is found to be using Jio Connect without necessary authorisation of the Company or in breach of the Terms and Conditions, the Company reserves the right to blacklist such user and/or disable access of Jio Connect to such user and/or terminate the services being provided by the Company to such user.
- The Company reserves the right, at its sole discretion, to terminate your access to any or all services of Jio Connect or any portion thereof at any time, without notice.
- GENERAL
- Age Restrictions: In order to use Jio Connect you must have a valid Jio ID or a Jio number, and you must be at least 18 years old. If you are under the age of 18 years, you should review the Terms and Conditions with your parent or legal guardian to make sure that you and your parent or legal guardian understand and agree to it.
- Use Restriction: You must not access Jio Connect if you are a person who is either barred or otherwise legally prohibited from receiving or using the Service or any services under the laws of India.
- Data Charges: The use of Jio Connect shall be subject to charges payable under the relevant pre-paid/post-paid plans availed by the users from the Company. You are solely responsible for all such fees.
- Updates: The Mobile Phone and Smart Wearable Device may install updates, bug fixes, patches, enhanced functions, missing plug-ins and new versions, from time to time (collectively, "Updates") to your Mobile Phone or Smart Wearable Device, as the case may be, for the purposes of enabling use of Jio Connect. Your use of Jio Connect requires that you have agreed to receive such automatically requested Updates. If you do not agree to such automatically requested and received Updates then please do not use Jio Connect.
- Company may, without notice to the user, (i) suspend the Jio Connect Service, and/or (ii) disconnect the user from the Jio Connect Service, which may at the discretion of Company become necessary due to any change in law, rules and regulations or due to marketing dynamics, or due to any change in the terms or conditions of the license granted by any regulatory authority to Company.
- USE WITH YOUR SMART WEARABLE DEVICE:
- The user of Jio Connect in your Smart Wearable Device and Mobile Phone shall be obligated to adhere to all the terms and conditions of the use of your Smart Wearable Device and Mobile Phone in addition to the Terms and Conditions. For avoidance of any doubt, the Company shall not be responsible for any losses arising out of or in connection with the Terms and Conditions for any failures, acts or omissions by the user of Jio Connect to comply with the terms and conditions for the use of the Smart Wearable Device and Mobile Phone.
- The user of the Jio Connect in the Smart Wearable Device and Mobile Phone acknowledges and agrees to abide by the terms and conditions of use of the Smart Wearable Device and Mobile Phone, as per its end user license agreement (EULA), including but not limited to the data privacy terms related thereto. The EULA, including the applicable data privacy terms and policy are made available on the Smart Wearable Device and Mobile Phone.
- INTELLECTUAL PROPERTY RIGHTS
- The Company or all the right holders in/of Jio Connect as the case may be, own title, interest and rights, including all related intellectual property rights in Jio Connect and the user acknowledges that such ownership shall include all intellectual property rights arising from any suggestions, enhancement requests, recommendations or other information provided by the user, whether in the course of use of Jio Connect, the Smart Wearable Device or otherwise.

- SEVERABILITY
- Where any particular term or provision of the Terms and Conditions is determined under applicable law to be un-enforceable, such un-enforceable term(s) shall be severed from and will not affect any other terms and conditions. The Company reserves the right to substitute any such un-enforceable term or provision with a suitable and enforceable provision at its sole discretion.
- DISPUTE RESOLUTION
- All disputes shall be governed under the laws of India and are subject to the exclusive jurisdiction of the Courts of Mumbai only. All other jurisdictions are specifically waived.
