SCOPE

• This application known as “My Jio” (“Application”) is  made available by Reliance Jio Infocomm Limited and/or its affiliates (“Company”, “we” or “us”), located at101, Saffron, Nr. Centre Point, Panchwati 5 Rasta, Ambawadi, Ahmedabad, Gujarat – 380006 India. The Application is owned and controlled by Jio Platforms Limited (“JPL”) and facilitates your access to various services and other facilities provided by the Company.
• The Application provides to its users, the ability to avail various services and/or facilities, including but not limited to information, entertainment, promotion and/or engagement services and/or facilities as may be provisioned thereunder (“Services”).
• Your (“you”, “your” or “user”) use of the Application is subject to these terms and conditions (“Terms”).
• Your use of the Application on: (i) any hand held phone (“Mobile Phone”) powered by android and/or iOS and/or KaiOS; or (ii) any device for the purposes of availing fiber to home (“FTTH”) services offered by the Company (each a “Device”) requires that you agree to these Terms and the privacy policy of the Application available at Privacy Policy.
• By downloading the Application and/or by registering or signing up to the Application, or otherwise having access to, receiving, and/or using the Application, you acknowledge to have read, understood and you consent to be governed and bound by these Terms and the Privacy Policy. You also permit to enable certain functions of the Device to find the location of your device, alter SD card contents, phone statistics and identity, mount and un-mount file systems, contacts saved in your device, conferencing/ call logs and history and associated and/or ancillary functions. You also consent to permit the Application to access the Wi-Fi connections on your device. In order to provide you an enhanced experience, the Application will automatically turn on Wi-Fi  on your Mobile Phone as and when it detects availability of  a trusted Wi-Fi network owned and operated by the Company and/or its affiliates.  The Company further reserves the right to conduct a quality check on the wifi which has automatically been connected with your Mobile Phone. The Application is designed to provide you best in class digital services experiences and for that you consent for turning on Wi-Fi on your device and off-loading of your Mobile Phone traffic to a trusted Wi-Fi network owned and operated by the Company and/or its affiliates, as identified by the Application. If you do not understand the Terms or the Privacy Policy, or do not accept or agree to any part of them, then you should not use the Application.
• The Terms are an electronic record in terms of the Information Technology Act, 2000 (as amended / re-enacted) (“IT Act") and rules thereunder, and is published in accordance with the provisions of Rule 3 (1) of the of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, which mandates for publishing of rules and regulations, privacy policy and terms of use for access or usage of Application. This electronic record is generated by a computer system and does not require any physical or digital signatures.

PRIVACY AND PROTECTION OF PERSONAL INFORMATION:

• Please refer to the Privacy Policy of the Application available Privacy Policy.
• Please note that your use of the Application or Services on your Device or download thereof from Google play store/Apple app store/Kai Store or any other store may be subject to the respective privacy policies as may be published or made available by the Device and Google play store/Apple app store/Kai store or any other store.

MODIFICATIONS:

• Modifications of the Terms: The Company reserves the right to change the Terms under which the Services are offered, including but not limited to the charges, if any, associated with the use of the Services. The Terms may be further modified based on changes in the business, legal and regulatory requirements and will be updated online. We will communicate any changes to these Terms to you. You are encouraged to periodically visit this page to review these Terms and any changes to it.
• Modification of Services: The Company reserves the right to add, modify or delete any content or features available in the Services at any time at its sole discretion.

LINKS TO THIRD PARTY SITES AND APPLICATIONS:

• The Application may contain links to other web sites/applications, whether in the form of a separate tab and/or facility within the Application or otherwise ("Linked Sites"). The Linked Sites may not be under the control of the Company and the Company is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site or any information transmitted on a Linked Site. The inclusion of any link does not imply endorsement by the Company of the site or any association with its operators.
• Any dealings with third parties (including advertisers) included within or available via the Linked Sites or participation in promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between you and the advertiser or other third party. The Company shall not be responsible or liable for any part of any such dealings or promotions.
• You acknowledge and agree that the use of any Linked Sites is governed by the terms of use, license agreement, privacy policy, or other such agreement stipulated by the relevant offeror of each such Linked Site. THE COMPANY DISCLAIMS ANY AND ALL RESPONSIBILITY FOR ANY DISCLOSURE OF INFORMATION OR ANY OTHER PRACTICE OF AN OFFEROR OF A LINKED SITE. THE COMPANY EXPRESSLY DISCLAIMS ANY WARRANTY WITH RESPECT TO YOUR PERSONAL OR OTHER INFORMATION THAT MAY BE COLLECTED, PROCESSED, SHARED OR RETAINED BY AN OFFEROR OF A LINKED SITE.
• The Company reserves the right to suspend and/or remove any Linked Site or disable any content forming part thereof at its sole discretion without any prior notice to you.

INTELLECTUAL PROPERTY RIGHTS

• The Company shall own title, interest and rights, including all related intellectual property rights, in/of the Application and/or your Device including but not limited to object code of the Application, features of services, which is/are protected by the applicable laws except the content owned by the user. You acknowledge that such ownership shall include all intellectual property rights arising from any suggestions, enhancement requests, recommendations or other information provided by the user, whether in the course of use of the Application, your Device or otherwise.

USE LIMITATIONS:

• The Application is merely intended for your personal and non-commercial use.
• As a condition of your use of the Application, you warrant to the Company that you will not use the Application for any purpose that is commercial, unlawful or prohibited by these Terms. You may not use the Application in any manner which could damage, disable, overburden or impair the Services or interfere with any other party's use and enjoyment of the Application.
• You are not entitled to use any kind of measures, mechanisms or tools (software or hardware) that could interfere with the functioning of the Application or any of its Services.
• You may not use the Services and/or Application if (i) you have been convicted of any offence under applicable law; and/or (ii) if you are under the age of 18 years.

GENERAL

• Registration: In order to use the Services through the Application, you are required to sign up for an account using: (i) a valid mobile number and/or user id with password; or (ii) any other mechanism as may be prescribed by the Company from time to time. In case the Device is used for the purposes of availing FTTH services of the Company, you are required to have an active subscription to the telecommunication services of the Company.
• Use Restriction: You must not access the Application if you are a person who is either barred or otherwise legally prohibited from receiving or using the Service or any Services under the laws of India.
  You shall not host, display, upload, modify, publish, transmit, update or share any information which:
  1. Belongs to another person and to which you do not have any right to;
  2. Is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling or otherwise unlawful in any manner whatsoever; or unlawfully threatening or unlawfully harassing including but not limited to “indecent representation of women” within the meaning of the Indecent Representation of Women (Prohibition) Act 1986;
  3. Is misleading in any way;
  4. Is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, paedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual;
  5. Harassing or advocates harassment of another person;
  6. Involves the transmission of “junk mail”, “chained letters”, or unsolicited mass mailing or “spamming”;
  7. Promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
  8. Infringes upon or violates any third party’s rights (including, but not limited to, intellectual property rights, rights of privacy or rights of publicity);
  9. Promotes an illegal or unauthorized copy of another person’s copyrighted work;
  10. Provides instructional information about illegal activities such as making and/ or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses;
  11. Solicits gambling or engages in any gambling activity which we in our sole discretion believe is or could be construed to be as illegal;
  12. Harms minors in any way;
  13. Violates any law for the time being in force;
  14. Impersonates another person;
  15. Contains software viruses or any other computer code, files or programs designed to interupt, destroy or limit the functionality of any computer resource; or contains any trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptiously intercept or expropriate any system, data or personal information;
  16. Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offense or prevents investigation of any offense or is insulting any other nation.
• Third-Party Fees: You may incur access or data fees from third parties (such as your internet provider or mobile carrier) in connection with your use of Services and of Application. You are solely responsible for all such fees.
• Updates: You may need to install updates to the Application or related software that we introduce from time to time to use of the Application. Services originating from the Application may communicate with the servers from time to time to check for available updates to the Services and to the functionality of the Application, such as bug fixes, patches, enhanced functions, missing plug-ins and new versions (collectively, "Updates"). Your use of the Services you have installed requires that you have agreed to receive such automatically requested Updates.
• Accuracy of Information: You agree that the information entered by you while profile creation/updation or using any of Services is true, current, complete and accurate in all respects. The Company is not responsible for any losses arising out of discrepancy in your data. You are solely responsible for maintaining confidentiality and security of your user account and for all activities that occur on or through your user account. The Company is not responsible for any losses arising out of the unauthorized use of your user account.
• AUTOMATIC WIFI CONNECTIVITY: The Company is merely facilitating the feature to offload the traffic from your Mobile Phone network onto a trusted wifi network owned and operated by the Company. The Company does not guarantee the speed and/or the performance of the wifi network connected. The Company shall not be liable for any loss incurred by you due to the automatic connection of your Mobile Phone with the trusted wifi network.

CONTENT IN THE SERVICES:

• You agree and acknowledge that all information such as data files, written text, computer software, music, audio files or other sounds, photographs, videos or other images (“Content”) which you may have access to as part of, or through your use of, the Services are the sole responsibility of the person from which such Content originated.
• The Company reserves the right (but shall have no obligation) to flag, filter or remove any or all Content from any Service. Before removing any Content from the Application the Company shall provide you with a notification explaining the action being taken and the grounds and reason for such action.
• You agree and acknowledge that by using the Services you may be exposed to Content that you may find offensive, indecent or objectionable and that, in this respect, you use the Services at your own risk.
• You agree that you are solely responsible for and that the Company has no responsibility to you or to any third party for any Content that you create, transmit or display while using the Services.
• All Content which is provided through the Application is provided by third parties. The Company does not aggregate or curate the Content made available in the Application and are governed by the terms and conditions of the respective third party and/or the affiliate providing such Content. You are encouraged to refer to the terms and conditions of such third parties and/or affiliate including but not limited to JioNews, JioTv+, JioEngage and JioCinema for content made available by them through the Application.

RESPONSIBLE GAMING:

• The Company cares for you. The Company tries to protect you who are at risk of potential negative effects of online gaming through a number of means. Most people play online for fun and entertainment, but we recognize that a small percentage of people will attempt to play when they’re underage or allow playing online to control them and affect their lives.
• The Company believes in providing a platform for entertainment only and not a platform for making monies.
• You are encouraged to read our responsible gaming policy for each contest and/or tournament the Company organises.

LIMITATION OF LIABILITY:

• TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE TO YOU FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF, OR INABILITY TO USE OR ACCESS, THE APPLICATION OR FOR ANY SECURITY BREACH OR ANY VIRUS, BUG, UNAUTHORIZED INTERVENTION, DEFECT, OR TECHNICAL MALFUNCTIONING OF THE APPLICATION, WHETHER OR NOT FORESEEABLE OR WHETHER OR NOT THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR BASED ON ANY THEORY OF LIABILITY, INCLUDING BREACH OF CONTRACT OR WARRANTY, NEGLIGENCE OR OTHER TORTIOUS ACTION, OR ANY OTHER CLAIM ARISING OUT, OF OR IN CONNECTION WITH, YOUR USE OF, OR ACCESS TO, THE APPLICATION OR THE CONTENT. FURTHER, THE COMPANY SHALL NOT BE LIABLE TO YOU FOR ANY TEMPORARY DISABLEMENT, PERMANENT DISCONTINUANCE OR MODIFICATION OF THE APPLICATION BY THE COMPANY OR FOR ANY CONSEQUENCES RESULTING FROM SUCH ACTIONS.
• YOU SHALL BE SOLELY RESPONSIBLE FOR OBTAINING AND MAINTAINING ANY EQUIPMENT AND ANCILLARY SERVICES (INCLUDING THE PAYMENT OF ANY ADDITIONAL FEES THEREFORE) REQUIRED TO CONNECT TO, ACCESS OR OTHERWISE USE THE SERVICES, INCLUDING, WITHOUT LIMITATION, VIDEO-ENABLED DEVICES, VIDEO COMMUNICATION SERVICES, MODEMS, HARDWARE, SERVERS, SOFTWARE, OPERATING SYSTEMS, REMOTE CONTROLLER, NETWORKING, WEB SERVERS, INTERNET AND TELEPHONE SERVICE (COLLECTIVELY, “EQUIPMENT”). YOU WILL ALSO BE RESPONSIBLE FOR MAINTAINING THE SECURITY OF THE EQUIPMENT AND FOR ALL USES OF THE EQUIPMENT WITH OR WITHOUT YOUR KNOWLEDGE OR CONSENT.
• YOU ARE SOLELY RESPONSIBLE FOR THE CONTENT AND OTHER MATERIALS YOU TRANSMIT THROUGH THE SERVICE OR SHARE WITH OTHER USERS OR RECIPIENTS. YOU WILL NOT TRANSMIT ANY CONTENT THAT YOU DID NOT CREATE OR THAT YOU DO NOT OWN ALL RIGHT, TITLE AND INTEREST IN AND TO, INCLUDING, WITHOUT LIMITATION, ALL COPYRIGHT AND RIGHTS OF PUBLICITY CONTAINED THEREIN.
• THE COMPANY AND/OR ITS RESPECTIVE AFFILIATES MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS AND ACCURACY OF THE INFORMATION, SOFTWARE AND SERVICES AND RELATED CONTENT CONTAINED ON THE APPLICATION FOR ANY PURPOSE. ALL SUCH INFORMATION, SOFTWARE AND SERVICES AND RELATED CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE COMPANY AND/OR ITS RESPECTIVE SUPPLIERS HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, AND SERVICES AND RELATED CONTENT, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
• YOU SPECIFICALLY AGREE THAT THE COMPANY SHALL NOT BE RESPONSIBLE FOR UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, ANY MATERIAL OR DATA SENT OR RECEIVED OR NOT SENT OR RECEIVED, OR ANY TRANSACTIONS ENTERED INTO THROUGH THE APPLICATION. YOU SPECIFICALLY AGREE THAT THE COMPANY IS NOT RESPONSIBLE OR LIABLE FOR ANY THREATENING, DEFAMATORY, OBSCENE, OFFENSIVE OR ILLEGAL SERVICES OR CONDUCT OF ANY OTHER PARTY OR ANY INFRINGEMENT OF ANOTHER'S RIGHTS, INCLUDING INTELLECTUAL PROPERTY RIGHTS. YOU SPECIFICALLY AGREE THAT THE COMPANY IS NOT RESPONSIBLE FOR ANY SERVICES SENT USING AND/OR INCLUDED IN THE APPLICATION BY ANY THIRD PARTY.
• IN NO EVENT SHALL THE COMPANY AND/OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR OR IN RELATION TO: (A) LOSS OF USE, DATA OR PROFITS ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF APPLICATION; (B) ANY DELAY OR INABILITY TO USE THE APPLICATION OR SERVICES; (C) THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION OR SERVICES OBTAINED THROUGH THE APPLICATION; (D) OR OTHERWISE ARISING OUT OF THE USE OF THE APPLICATION OR THE SERVICES OF THE COMPANY; WHETHER OR NOT ALL OF THE ABOVE LOSSES, CLAIMS OR DAMAGES ARE BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, EVEN IF THE COMPANY AND/OR ITS AFFILIATES AND/OR ITS ASSOCIATES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSSES, CLAIMS OR DAMAGES.

TERMINATION (TEMPORARY AND PERMANENT DISABLEMENT):

• Unless otherwise provided in these Terms, the Services offered to you may be terminated by the Company without assigning any reasons at any time at the sole discretion of the Company. Upon termination / suspension, you shall not have the right to use or access the Application/Services.
• The Company reserves the right to suspend and/ or terminate your access to the Services in case of any non-adherence to these Terms and Conditions by you

GOVERNING LAW AND DISPUTE RESOLUTION:

• These terms and conditions are governed and construed in accordance with the laws of India. The courts in Mumbai shall have exclusive jurisdiction to hear disputes arising out of these terms.

FORCE MAJEURE:

• The Company shall be under no liability whatsoever in the event of non-availability of any portion of the Application or subscribed content occasioned by act of God, war, disease, revolution, riot, civil commotion, strike, lockout, flood, fire, failure of any public utility, man-made disaster, infrastructure failure or any other cause whatsoever beyond the control of the Company.

SEVERABILITY

• If any of the provisions of these Terms are deemed invalid, void, or for any reason unenforceable, that part of these Terms will be deemed severable and will not affect the validity and enforceability of any remaining provisions of these Terms.

SCOPE

• Jio Wallet is a closed system pre-paid payment instrument available for availing electronic recharges, recharge values in electronic form and such other products and services of Reliance Retail Limited, located at 3rd Floor, Court House, Lokmanya Tilak Marg, Dhobi Talao, Mumbai – 400 002, Maharashtra, India (“Company”, “we”, “us” and “our”) associated with telecommunication services distributed by the Company, whether made available on www.Jio.comMyJio mobile application and/or any other platform(s) as decided by the Company from time to time (hereinafter referred to as “Platform”) (“Jio Wallet”).
• Jio Wallet is made available by the Company and /or its affiliates to enable its users (i) load money in the Jio Wallet via payment modes including UPI, credit or debit cards and net-banking available on the Platform; (ii) use Jio Wallet to making payments towards any Transactions (hereinafter defined) on the Platform only; and (iii) such other ancillary services as may be provided by the Company from time to time (collectively known as “Services”) on any compatible smart phones powered by Android iOS, and KaiOS (each a “Device”).
• Users cannot use the Jio Wallet (i) to make any cash withdrawals; (ii) for payment or settlement for third party service; and (iii) to purchase of another prepaid payment instrument.
• Your (“you”, “your” or “user”) use of the Jio Wallet is subject to these terms and conditions (“Terms”).
• Your use of the Jio Wallet on the Platform requires that you agree to these Terms and the privacy policy of the Jio Wallet. By downloading the Jio Wallet and by registering or signing up to the Jio Wallet, or otherwise having access to, receiving, and/or using the Jio Wallet, you acknowledge to have read, understood and you consent to be governed and bound by these Terms and the privacy policy of the Jio Wallet. DEFINITIONS

• "User" or "you" means a person who has registered on the Platform and is an active subscriber availing telecommunication services from Reliance Jio Infocomm Limited ("RJIL"), who has accepted the Terms, and who owns, operates, or has access to an internet compatible device that supports the Platform.
• "Jio Wallet Account" means the user’s Jio Wallet account issued by accepting minimum user details, i.e. user name, e-mail address, mobile number, which permit payment for availing Services.
• "KYC" or "know your customer" refers to the personal identification and other information required by the Platform from you before any Services can be provided. KYC documents/ information may be required by the Platform from the user at the time of registration and/or on a later date, for availing and/or continuation of Services.
• "Transaction" means purchase of electronic recharges, recharge values in electronic form and such other products and services of the Company associated with telecommunication services distributed by the Company as-is from the Platform.

You may not use the Jio Wallet in any manner which could damage, disable, overburden or impair the Services or interfere with any other party's use and enjoyment of the Jio Wallet.
• You are not entitled to use any kind of measures, mechanisms or tools (software or hardware) that could interfere with the functioning of the Jio Wallet or any of its Services.
• You may not use the Services and/or Jio Wallet if (i) you have been convicted of any offence under applicable law; (ii) if you are under the age of 18 years; (iii) you are not an Indian resident and do not have an Indian bank account.
• You agree that you will not upload on the Services, any Content that is contrary to the Terms and Conditions and the Company’s content guidelines, the Privacy Policy, or any other policy of Company, as updated from time to time, or that is contrary to applicable laws and regulations. If any such Content is uploaded on the Services and in your account in any manner and for any reason whatsoever, you shall ensure that such Content is deleted from the Services and your account immediately.
  Jio Wallet shall be used for Transactions (i) only on the Platform where such option is shown as approved mode of payment; and (ii) for such telecommunication service connections as permitted by the Platform; and (iii) only where the value of such Transaction is less than or equal to the available balance on the Jio Wallet.
• Refunds for Transactions where Jio Wallet is approved as a payment method shall be processed in the same mode of payment only.
• Any refund for recharge failure or plan activation failure shall be done through the Platform’s customer care only.
• All applicable refunds shall be processed within T+7 working days
• Any amount transferred erroneously by the user, while adding money to or recharging the Jio Wallet or while executing Transaction on the Platform, shall not be refunded to the user by Jio Wallet under any circumstances.
• Any web-link on the Platform to a third-party site is not an endorsement of that web-link. By using or browsing any such other web-link, you shall be subject to the terms and conditions in relation to that web-link.
• The Company shall send all customer communications by SMS and/or e-mail and such SMS shall be deemed to have been received by you after they have been submitted for delivery to the mobile phone operator.
• You agree that nothing in these Terms shall be deemed to create an agency or employment relationship, a franchisor-franchisee relationship, joint venture or partnership between you and the Company.
• The privacy policy of Jio Wallet applies to use of the Platform, and its terms are made a part of the terms and conditions by this reference. Additionally, by using the Platform, you acknowledge and agree that internet transmissions are never completely private or secure. You understand that any message or information you send to the Platform may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.

USER NAMES AND PASSWORDS

• You may be required to register and verify your KYC information in order to access Jio Wallet using the means and methodology as provided by the Company from time to time
• You are responsible for maintaining the confidentiality of any password you use to access the Jio Wallet and you agree not to transfer such passwords or user names or lend or otherwise transfer your use or access to the Jio Wallet to any third party. You agree to notify us of any unauthorized use of your passwords or user names or any other breach of security related to your account of which you become aware. You are fully responsible for all use of the Jio Wallet and any Services that occur in connection with your user name, except to the extent that any unauthorized use is not caused by any breach of your obligations under these Terms.

GENERAL TERMS AND CONDITIONS FOR JIO WALLET

• You may add money to or recharge your Jio Wallet through online payment methods such as UPI, credit/debit card and net banking. Except as provided hereunder, amount in your Jio Wallet will not be refunded to you under any circumstances. No interest will be payable by the Company on the available balance amount in the Jio Wallet.
• You may note that withdrawing money from Jio Wallet is not allowed. Any outstanding credit in the Jio Wallet must be utilized only to make payments for bona fide Transactions with Jio Wallet on the Platform.
• Jio Wallets are not transferable
• You may add money into your Jio Wallet up to a maximum of INR 10,000 (Rupees ten thousand Only). This limit will be inclusive of any credits made by you and any refunds received by you for any Transactions in your Jio Wallet. Additionally, the balance in your Jio Wallet shall not exceed INR 10,000 (Rupees ten thousand Only) at any relevant time of determination. These limits may be reviewed and modified at the discretion of the Company without prior intimation to the Customer.
• The Company reserves the right to suspend/discontinue Services to you at any time, for any cause, including -
  • For any suspected violation of the Terms
  • For any suspected discrepancy, errors or misrepresentations in the particular(s) or KYC documentation provided by you
  • For any infringement of our or a third party’s intellectual property rights
  • For decompiling, disassembling or reverse engineering (including any attempts to do the same) any of the software or other materials provided on or through the Jio Wallet or the Platform
  • For removing, circumventing or damaging any security features or technical features of the Jio Wallet
  • For modifying, adapting, copying or making derivative works of the Jio Wallet or the Platform
  • To combat potential fraud, sabotage, wilful destruction, threat to national security or for any other force majeure event
  • If the same is due to technical failure, modification, upgradation, variation, relocation, repair, and/or maintenance due to any emergency or for any technical reasons
  • If the same is due to any transmission deficiencies caused by topographical and geographical constraints/limitations
  • If the mobile connection with which your Jio Wallet is related ceases to be operational or in your possession or control
  • If the Company believes, in its reasonable opinion, that cessation/suspension is necessary for any other legitimate purpose
• In addition to the foregoing, the Company reserves the right to suspend/discontinue Services to you at any time, for any cause, including for breach of any terms and conditions, privacy policy or any other policies relevant to the Jio Wallet, as provided by the Company.
• You are permitted to maintain and operate only one Jio Wallet. Any suspected non-conformity with this requirement shall constitute grounds for the suspension/discontinuation by the Company of any of all Jio Wallets associated with you on the Platform. Any operation of or continued availability of any facility respect to the Jio Wallets from time to time shall be subject to any requirements under applicable laws, and any new regulations or directions from any regulatory authorities in India.
• Any value in your Jio Wallet that is utilized towards making payments for any Transaction shall be automatically debited from your Jio Wallet.

OBLIGATIONS AND CONSENT

• You acknowledge that any purchase or payment made using the Jio Wallet is on the basis of your own discretion and not on the basis of any recommendations made by the Company and that Jio Wallet does not endorse, promote or warrant any product and/or services that might be bought/availed or proposed to be bought/availed using Jio Wallet.
• Jio Wallet availability is subject to the maintenance of an active mobile phone or internet connection with an associated telecom provider and compatibility of a mobile phone handset or any other handset or other application on which the Platform can run and the user is solely responsible for all liability arising from unavailability of the Platform due to a deficient mobile handset or the internet service provider not being able to support any Jio Wallet channel or application.
• You must ensure the availability of sufficient funds in your Jio Wallet before executing any Transaction from your Jio Wallet.
• You acknowledge and understand that Jio Wallet is linked to your mobile phone number with Reliance Jio Infocomm Limited and the Platform shall under no circumstances be responsible for any liability arising out of the loss/theft/misuse of the mobile phone number or deactivation of mobile connection by RJIL.
• Information submitted by you for availing Jio Wallet and/or information submitted while using Jio Wallet may be shared by the Company with: (i) any affiliate of the Company; or (ii) any third party including the Company, inter alia, to facilitate the provision of Jio Wallet or for the purposes specified in the Terms.
• By registering to use the Jio Wallet, you consent to conduct Transactions and receive communications, notices and information from us electronically, relating to your Transactions using the Jio Wallet as well as any related information regarding the Platform and its services from the Company via SMS, calls or emails or other electronic means during the period of your use of the Jio Wallet. You further agree to provide any other consents required under law to facilitate the Company sending such messages to you.
• Electronic communications shall be deemed to have been received by you when the Company sends an electronic communication to your e-mail address/mobile number as per our records, or when an electronic communication is posted on the Platform. The pre-requisites for effective electronic transactions and communications are as follows: (a) you must have access to the internet through a broadband connection or mobile data or through any other applications; and (b) you must have a valid e-mail address and mobile number. You can withdraw your consent for electronic communication at any time by contacting the Company, but the Company reserves the right to terminate your Jio Wallet account, as the case may be, upon such withdrawal. Withdrawal of your consent for electronic communication will not affect the legal validity and enforceability of any notice, statement or disclosure previously received electronically. You agree to notify the Company promptly if your email address, mobile number or other contact information changes by updating your account information or contacting the Company.

GENERAL

• By using our Services you hereby agree to ensure that the explicit prohibitions mentioned in section 8.3 are at all times adhered to
• Use Restriction: You must not access the Jio Wallet if you are a person who is either barred or otherwise legally prohibited from receiving or using the Service or any Services under the laws of India.
• You shall not host, display, upload, modify, publish, transmit, update or share any information which:
  • Belongs to another person and to which you do not have any right to
  • Is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling or otherwise unlawful in any manner whatsoever; or unlawfully threatening or unlawfully harassing including but not limited to “indecent representation of women” within the meaning of the Indecent Representation of Women (Prohibition) Act 1986
  • Is misleading in any way
  • Is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, paedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual
  • Harassing or advocates harassment of another person
  • Involves the transmission of “junk mail”, “chained letters”, or unsolicited mass mailing or “spamming”
  • Promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous
  • Infringes upon or violates any third party’s rights (including, but not limited to, intellectual property rights, rights of privacy or rights of publicity)
  • Promotes an illegal or unauthorized copy of another person’s copyrighted work
  • Provides instructional information about illegal activities such as making and/ or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses
  • Solicits gambling or engages in any gambling activity which we in our sole discretion believe is or could be construed to be as illegal
  • Harms minors in any way
  • Violates any law for the time being in force
  • Impersonates another person
  • Contains software viruses or any other computer code, files or programs designed to interupt, destroy or limit the functionality of any computer resource; or contains any trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptiously intercept or expropriate any system, data or personal information
  • Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offense or prevents investigation of any offense or is insulting any other nation.
• Services may be made available for free of cost or for a specified cost as may be decided by the Company from time to time.
• Third-Party Fees: You may incur access or data fees from third parties (such as your internet provider or mobile carrier) in connection with your use of Services and of Jio Wallet. You are solely responsible for all such fees
• Updates: You may need to install updates to the Jio Wallet or related software that we introduce from time to time to use of the Jio Wallet. Services originating from the Jio Wallet may communicate with the servers from time to time to check for available updates to the Services and to the functionality of the Jio Wallet, such as bug fixes, patches, enhanced functions, missing plug-ins and new versions (collectively, "Updates"). Your use of the Services you have installed requires that you have agreed to receive such automatically requested Updates
• Accuracy of Information: You agree that the information entered by you while profile creation/ updation or using any of Services is true, current, complete and accurate in all respects. The Company is not responsible for any losses arising out of discrepancy in your data. You are solely responsible for maintaining confidentiality and security of your user account and for all activities that occur on or through your user account. The Company is not responsible for any losses arising out of the unauthorized use of your user account

LIABILITY DISCLAIMER

• TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE TO YOU FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF, OR INABILITY TO USE OR ACCESS, THE JIO WALLET OR FOR ANY SECURITY BREACH OR ANY VIRUS, BUG, UNAUTHORIZED INTERVENTION, DEFECT, OR TECHNICAL MALFUNCTIONING OF THE JIO WALLET, WHETHER OR NOT FORESEEABLE OR WHETHER OR NOT THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR BASED ON ANY THEORY OF LIABILITY, INCLUDING BREACH OF CONTRACT OR WARRANTY, NEGLIGENCE OR OTHER TORTIOUS ACTION, OR ANY OTHER CLAIM ARISING OUT, OF OR IN CONNECTION WITH, YOUR USE OF, OR ACCESS TO, THE JIO WALLET OR THE CONTENT. FURTHER, THE COMPANY SHALL NOT BE LIABLE TO YOU FOR ANY TEMPORARY DISABLEMENT, PERMANENT DISCONTINUANCE OR MODIFICATION OF THE JIO WALLET BY THE COMPANY OR FOR ANY CONSEQUENCES RESULTING FROM SUCH ACTIONS.
• YOU SHALL BE SOLELY RESPONSIBLE FOR OBTAINING AND MAINTAINING ANY EQUIPMENT AND ANCILLARY SERVICES (INCLUDING THE PAYMENT OF ANY ADDITIONAL FEES THEREFORE) REQUIRED TO CONNECT TO, ACCESS OR OTHERWISE USE THE SERVICES, INCLUDING, WITHOUT LIMITATION, VIDEO-ENABLED DEVICES, VIDEO COMMUNICATION SERVICES, MODEMS, HARDWARE, SERVERS, SOFTWARE, OPERATING SYSTEMS, NETWORKING, WEB SERVERS, INTERNET AND TELEPHONE SERVICE (COLLECTIVELY, “EQUIPMENT”). YOU WILL ALSO BE RESPONSIBLE FOR MAINTAINING THE SECURITY OF THE EQUIPMENT AND FOR ALL USES OF THE EQUIPMENT WITH OR WITHOUT YOUR KNOWLEDGE OR CONSENT
• YOU ARE SOLELY RESPONSIBLE FOR THE CONTENT AND OTHER MATERIALS YOU TRANSMIT THROUGH THE SERVICE OR SHARE WITH OTHER USERS OR RECIPIENTS. YOU WILL NOT TRANSMIT ANY CONTENT THAT YOU DID NOT CREATE OR THAT YOU DO NOT OWN ALL RIGHT, TITLE AND INTEREST IN AND TO, INCLUDING, WITHOUT LIMITATION, ALL COPYRIGHT AND RIGHTS OF PUBLICITY CONTAINED THEREIN.
• THE COMPANY AND/OR ITS RESPECTIVE AFFILIATES MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS AND ACCURACY OF THE INFORMATION, SOFTWARE AND SERVICES AND RELATED CONTENT CONTAINED ON THE JIO WALLET FOR ANY PURPOSE. ALL SUCH INFORMATION, SOFTWARE AND SERVICES AND RELATED CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE COMPANY AND/OR ITS RESPECTIVE SUPPLIERS HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, AND SERVICES AND RELATED CONTENT, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT
• YOU SPECIFICALLY AGREE THAT THE COMPANY SHALL NOT BE RESPONSIBLE FOR UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, ANY MATERIAL OR DATA SENT OR RECEIVED OR NOT SENT OR RECEIVED, OR ANY TRANSACTIONS ENTERED INTO THROUGH THE JIO WALLET. YOU SPECIFICALLY AGREE THAT THE COMPANY IS NOT RESPONSIBLE OR LIABLE FOR ANY THREATENING, DEFAMATORY, OBSCENE, OFFENSIVE OR ILLEGAL SERVICES OR CONDUCT OF ANY OTHER PARTY OR ANY INFRINGEMENT OF ANOTHER'S RIGHTS, INCLUDING INTELLECTUAL PROPERTY RIGHTS. YOU SPECIFICALLY AGREE THAT THE COMPANY IS NOT RESPONSIBLE FOR ANY SERVICES SENT USING AND/OR INCLUDED IN THE JIO WALLET BY ANY THIRD PARTY
• IN NO EVENT SHALL THE COMPANY AND/OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR OR IN RELATION TO: (A) LOSS OF USE, DATA OR PROFITS ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF JIO WALLET; (B) ANY DELAY OR INABILITY TO USE THE JIO WALLET OR SERVICES; (C) THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION OR SERVICES OBTAINED THROUGH THE JIO WALLET; (D) OR OTHERWISE ARISING OUT OF THE USE OF THE JIO WALLET OR THE SERVICES OF THE COMPANY; WHETHER OR NOT ALL OF THE ABOVE LOSSES, CLAIMS OR DAMAGES ARE BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, EVEN IF THE COMPANY AND/OR ITS AFFILIATES AND/OR ITS ASSOCIATES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSSES, CLAIMS OR DAMAGES.

INDEMNIFICATION

• You agree to indemnify, save, and hold the Company, its affiliates, contractors, employees, officers, directors, agents and its third party suppliers, licensors, and partners harmless from any and all claims, losses, damages, and liabilities, costs and expenses, including without limitation legal fees and expenses, arising out of or related to : (i) your use or misuse of the Jio Wallet; (ii) any violation by you of the applicable law or the terms and conditions, including the Terms; or (iii) any breach of the representations, warranties, and covenants made by you herein. The Company reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify the Company, including rights to settle, and you agree to cooperate with the defense of the Company and settlement of these claims. The Company will use reasonable efforts to notify you of any claim, action, or proceeding brought by a third party that is subject to the foregoing indemnification upon becoming aware of it. This paragraph shall survive termination of these Terms.

TERMINATION (TEMPORARY AND PERMANENT DISABLEMENT)

• Unless otherwise provided in these Terms, the Services offered to you may be terminated by the Company without assigning any reasons at any time at the sole discretion of the Company. Upon termination / suspension, you shall not have the right to use or access the Jio Wallet/Services.
• The Company reserves the right to suspend and/ or terminate your access to the Services in case of any non-adherence to these Terms and Conditions by you.

GOVERNING LAW AND DISPUTE RESOLUTION

• These terms and conditions are governed and construed in accordance with the laws of India. The courts in Mumbai shall have exclusive jurisdiction to hear disputes arising out of these terms.

FORCE MAJEURE

• The Company shall be under no liability whatsoever in the event of non-availability of any portion of the Jio Wallet or subscribed content occasioned by act of God, war, disease, revolution, riot, civil commotion, strike, lockout, flood, fire, failure of any public utility, manmade disaster, infrastructure failure or any other cause whatsoever beyond the control of the Company.

SEVERABILITY

• If any of the provisions of these Terms are deemed invalid, void, or for any reason unenforceable, that part of these Terms will be deemed severable and will not affect the validity and enforceability of any remaining provisions of these Terms.
