SUBJECT OFFER:

• This “JioPhone Match Pass” offer (“Subject Offer”) applies to Successful Referrals of the JioPhone made by a Jio Subscriber to his/her friends and/or family.
• The Subject Offer is being offered by RJIO for the purposes of promotion of its services on the JioPhone.

DEFINITIONS:

• Capitalized expressions used in the Subject Offer shall have meaning ascribed to them as shown herein-below:
  • “Referrer” shall mean (i) an individual Jio Subscriber, who refers a Referee for the purposes of achieving a Successful Referral under the Subject Offer by inviting the Referee to call a toll-free IVR number -1800 890 8900 and register the Referrer’s RJIO number;
  • "Referee” shall mean any individual and/or person who is not an existing user of a JioPhone, and who, upon being referred by a Referrer under the Subject Offer, calls the toll-free IVR to nominate the Referrer’s RJIO number and the PIN code of the Referee’s location;
  • “Successful Referral” shall mean the successful completion by a Referee of all of the following conditions, namely: (i) using the IVR process to nominate the Referrer’s RJIO number and furnishing the PIN code of the Referee’s location; and (ii) completing the e-KYC process, including registration of the mobile number used by the Referee during the IVR process, as the alternative number for the Referee; and (iii) acceptance of the terms and conditions for availment of the JioPhone; and (iv) payment of necessary security deposit and taking delivery of the JioPhone in accordance with the terms and conditions stipulated therefor; and (v) activation of the services of RJIO on such JioPhone availed.
  • “Special Benefit” shall mean an opportunity for Eligible Referrers to be featured in any episode of the television programme titled “Jio Dhan Dhana Dhan” to be aired on the JioTV mobile app and the television channel - Colours TV, through a video call integration wherein the Eligible Referrers may interact with the host of the said television programme, Mr. Sunil Grover and/or any celebrity guests invited for the said programme during the episode then being aired.
  • “Eligible Week” shall mean such week or other periodicity as determined by RJIO at its sole discretion during the Offer Period, for the purposes of offering the Special Benefit to Eligible Referrers. For the sake of clarity, RJIO shall have the absolute discretion to determine the commencement, periodicity and continuance of the Eligible for the purposes of offering the Special Benefit at all times.
  • “Eligible Referrers” shall mean two Referrers who achieve the highest number of Successful Referrals in one Eligible Week as determined by RJIO. RJIO shall determine the said two Referrers either on the criteria of them achieving the first and second highest number of Successful Referrals in the Eligible Week and if there are more than two Referrers achieving the highest number of Successful Referrals in the Eligible Week, then on the basis of a randomizer deployed by [RJIO] for determining two Referrers from and amongst those who have achieved the highest number of Successful Referrals.
  • “Jio Subscriber” shall mean a valid and active subscriber of telecommunication services provided by RJIO, having an active plan with RJIO during the Offer Period.
  • RJIO” or “Company” shall mean Reliance Jio Infocomm Limited.
  • “4-Day IPL Special Pack” shall mean non-transferable 8 GB data voucher offered by RJIO, subject to an FUP of 2GB per day for a 4 day validity period. The 4-Day IPL Special Pack will be stacked and queued automatically, and the data benefits will be in addition to the data entitlement under the plan then being availed. For avoidance of doubt, the 4-Day IPL Special Pack, if not utilized when stacked on your account shall stand forfeited .
  • “Offer Period” shall mean from the 7th of April 2018 till the 27th of May 2018.
  • “JioPhone” shall mean the phone marketed under the said name and offered by Reliance Retail Limited as per specifications and together with specified accessories as provided on the website ‘www.jiophone.com’.

BENEFITS OF THE SUBJECT OFFER:

• For up to 10 Successful Referrals made through a Referrer during the Offer Period, the Referrer and the Referee shall be entitled to avail the benefits as specified herein-under:
  • For every such Successful Referral, the Referee performing such Successful Referral shall be entitled to avail one 4-Day IPL Special Pack which is valid for 4 days from the date of such availment and during the Offer Period;
  • Where the number of Successful Referrals made through a Referrer are between 1 to 4 or 6 to 9, the relevant Referrer shall be entitled to avail per such Successful Referral, one 4-Day IPL Special Pack which is valid for 4 days from the date of such availment and which can be availed in a single recharge cycle period only;
  • Where the number of Successful Referrals are either 5 or 10, the relevant Referrer shall be entitled to avail three 4-Day IPL Special Packs which will be valid for 12 days from the date of such availment
• During every Eligible Week, the Eligible Referrers will have the opportunity to avail the Special Benefit subject to the process laid out for such availment in the Subject Offer as provided herein-below:
  • RJIO will attempt to contact the Eligible Referrers only on the RJIO number registered with RJIO;
  • Where the Eligible Referrer does not respond on two such attempts to contact or where the Eligible Referrer so contacted fails to accept or delays acceptance or conditionally accepts the Special Benefit, the Special Benefit shall stand automatically forfeited by such Eligible Referrer. RJIO shall have the absolute right to nominate any other Referrer for the Special Benefit upon any such forfeiture by the Eligible Referrer. No liability of any kind or nature shall ensue to RJIO on account of any such forfeiture or RJIO’s decision to nominate any other Referrer upon such forfeiture;
  • RJIO is not responsible in any manner for the conduct of the television programme forming part of the Special Benefit and shall not be liable for any costs, expenses or consequences arising from the participation by the Eligible Referrer in such programme, in any manner whatsoever. Such participation shall be deemed to have been voluntarily made by the Eligible Referrer at all times. The Eligible Referrer shall however be responsible and liable to RJIO in the event of any refusal to participate or failure to adhere to any rules for participation as may be communicated by the relevant television channel at all times.
  • Once a Referrer is nominated as an Eligible Referrer for any Eligible Week, such Referrer shall not be considered for nomination again as the Eligible Referrer in any other subsequent Eligible Weeks;
  • At no point of time is RJIO obliged to notify any forfeiture or withdrawal of Special Benefit to any person, including the Eligible Referrer, in writing.

GENERAL TERMS AND CONDITIONS

• Registration or participation in the Subject Offer does not guarantee any benefits as specified in the Subject Offer.
• Both Referrers and Referees are solely responsible for using valid and active mobile numbers for the purposes of the Subject Program and in accordance with the terms and conditions stipulated herein. RJIO shall not be responsible for any failure or inability, whether temporary or otherwise and for whatsoever reasons, which prevents a Referrer or a Referee from performing any actions contemplated under the Subject Offer using the said mobile numbers.
• The T&C shall be read concomitantly with [the JioPhone terms & conditions] and the customer application form executed by the Jio Subscriber.
• The Subject Offer can't be clubbed with any other offer. The Subject Offer cannot be used in conjunction with any other alternative offer or promotion of a similar nature.
• RJIO reserves the right to cancel/withdraw or modify the Subject Offer or any part thereof, at any time, without any prior intimation.
• RJIO has the right at all times to undertake any activity envisaged in terms of the Subject Offer through any of its affiliates and/or associates, and where any such activity is performed through any affiliate and/or associate of RJIO, all references in the Subject Offer to RJIO shall be deemed to additionally include any such affiliate and/or associate.
• In no event shall RJIL or its directors, officers, employees, agents or other representatives be responsible or liable for any direct, indirect, special, incidental, consequential, or punitive damages, or any other damages of any kind, arising out of or related to the Subject Offer.
• All benefits offered under the Subject Offer are non-transferable.
• The Subject Offer is subject to guidelines/directions issued by Telecom Regulatory Authority of India (TRAI), Department of Telecommunications (DOT) or any other statutory authority from time to time.
• The Referrer and Referee hereby severally authorize RJIL to collect his/her personal information including name, address and mobile number etc. and share with its partners so as to enable them to avail the Subject Offer. Personal information of the Referrer and/or Referee will be stored and processed in accordance with RJIL’s Privacy Policy which is available at www.jio.com.

• Any participation in the Subject Offer does not assure the availability of the JioPhone or RJIO SIM and RJIO, in no circumstances shall be liable for non-availability thereof.
• RJIO is not liable to or responsible for any and all claims, issues, damages or losses with respect to the JioPhone and RJIO hereby disclaims, any and all such claims, losses and liabilities, whether or not arising out of, or in connection therewith. This disclaimer shall apply to the fullest extent permitted by law and shall survive cancellation/termination/determination of the Subject Offer.
• In no event shall RJIO or its directors, officers, employees, agents or other representatives thereof be responsible or liable for any direct, indirect, special, incidental, consequential, or punitive damages, or any other damages of any kind, arising out of or related to the Subject Offer.
• All decisions and determinations to be made in terms of the Subject Offer, including interpretation of any of the said terms and conditions, shall be made solely by RJIO, whose decision and/or determination shall be final and binding on all parties.
• Any disputes arising out of and in connection with this Offer shall be subject to the exclusive jurisdiction of the courts of Mumbai only.
• Every participant in the Subject Offer hereby agrees that he/she has read, understood and voluntarily agrees to all the terms and conditions of the Subject Offer.
